Terms of Service

These terms form a contract between you and Kyle Marham, trading as Blue Dog Digital, Wales, UK (“Moss & Tale”, “we”, “us”). By creating an account you agree to them. If you do not agree, do not use the service.
1. Who can use Moss & Tale
- You must be 18 or older to create an account.
- You must be the parent or legal guardian of any child whose information you enter.
- Moss & Tale is for personal, household use only. Commercial use is not permitted.
2. The service
Moss & Tale generates personalised bedtime stories using artificial intelligence, based on child profile information you provide. Stories are generated automatically and delivered by notification email and in-app.
We make reasonable efforts to ensure story quality and child-appropriateness. All stories pass an automated safety filter. However, AI-generated content is not perfect — you are responsible for reviewing stories before sharing them with your child. You can flag any story you are concerned about using the in-app flag feature.
We do not guarantee any specific story frequency, quality, or availability. We may change, suspend, or discontinue the service with reasonable notice.
3. Subscriptions and billing
Free tier: 1 child profile, text-only stories, last 7 days of stories. No payment required.
Premium (£6.99/month): Up to 5 children, story illustrations, full library, up to 3 on-demand stories per month.
Family (£9.99/month): Unlimited children, full library, up to 5 on-demand stories per month.
Subscriptions are billed monthly in advance and auto-renew until cancelled. We will notify you by email before your first renewal and every 6 months thereafter. You can cancel at any time in Settings — your access continues to the end of the paid period.
We will give you at least 30 days’ notice of any price increase. If you do not cancel before the new price takes effect, you accept the new price.
4. Your right to cancel (cooling-off)
Under the Consumer Contracts Regulations 2013, you have a 14-day right to cancel a new paid subscription from the date of purchase, with a full refund — no reason needed.
If you ask us to begin providing the paid service immediately (which we do by default), you acknowledge that you may lose the right to a full refund if you have already used premium features during the 14-day window. We will refund a pro-rata amount for unused days in that case.
To exercise your right to cancel, email hello@mossandtale.com within 14 days of purchase. Include your account email and “cancellation request” in the subject line.
5. Your content and intellectual property
You own the information you provide about your child. You grant us a licence to use it solely to operate the service — generating stories, storing them in your account, and delivering them to you.
Stories generated by Moss & Tale using your child's profile are yours to read, save, print, and share for personal, non-commercial use within your household. You may not sell, license, or publish them commercially.
The Moss & Tale platform, software, design, and brand are owned by Blue Dog Digital. You may not copy, reverse-engineer, or create derivative works from them.
6. Acceptable use
You agree not to:
- Provide false information about a child's age or identity
- Attempt to generate content that is harmful, offensive, or inappropriate for children
- Use automated tools to access or scrape the service
- Attempt to circumvent subscription limits or credits
- Resell or sublicense access to the service
- Use the service for any unlawful purpose
We may suspend or terminate your account if you breach these terms, with or without prior notice depending on severity.
7. Liability and limitations
Moss & Tale is provided “as is”. To the fullest extent permitted by UK law, we are not liable for:
- Indirect, consequential, or special losses
- Loss of data, profits, or business
- Content generated by the AI that does not meet your expectations
- Service unavailability due to planned maintenance or third-party outages
Our total liability to you in any 12-month period is limited to the total subscription fees you paid in that period.
Nothing in these terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under the Consumer Rights Act 2015 or other applicable UK law.
8. Your data
Our Privacy Policy explains how we collect, use, and protect your data and your child's data. Child profile data is used only to generate stories. We never sell it.
On account closure, child profile data is deleted within 30 days. Story text and illustrations associated with your account are also deleted within 30 days. Account and billing records are retained for 6 years as required by UK tax law.
9. Changes to these terms
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance.
10. Governing law and disputes
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
